America & Beyond (“we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect your personal information when you visit our website at americaandbeyond.com, use our mobile application, or otherwise interact with our services (collectively, the “Services”). Please read this Privacy Policy carefully. By using the Services, you acknowledge the practices described here.

1. Our Commitment to Your Privacy

We design our privacy practices to comply with applicable law, including:

  • The California Consumer Privacy Act, as amended by the California Privacy Rights Act (CCPA/CPRA)
  • The U.S. Federal Electronic Communications Privacy Act and Computer Fraud and Abuse Act
  • The EU/UK General Data Protection Regulation (GDPR), for visitors located in the EU/EEA or UK
  • Canada's Personal Information Protection and Electronic Documents Act (PIPEDA), for visitors located in
    Canada

2. Information We Collect

We collect information that identifies, relates to, describes, or could reasonably be linked, directly or indirectly, with you (“Personal Information”), including: 

  • Identifiers: name, email address, phone number, account credentials, shipping and billing address
  • Financial Information: payment card information processed at checkout (we do not store full card numbers — this is handled by our PCI-DSS compliant payment processor) 
  • Commercial Information: products purchased, order history, purchasing preferences
  • Communications: messages you send us via email, chat, phone, or contact forms
  • Internet/Network Activity: IP address, browser and device type, pages viewed, and browsing behavior on
    the Services
  • General Location Information: city- or postal-code-level location inferred from IP address
  • Demographic Information: age range or birthdate, and gender or gender identity, only where voluntarily provided
  • Audio Information: voice recordings, only if you contact our customer service line and calls are recorded (with notice provided at the start of the call)

We do not collect Social Security numbers, government ID numbers, precise geolocation, health information, or other Sensitive Personal Information as defined under CPRA, except to the limited extent voluntarily provided by you in a customer service interaction. If we ever begin collecting Sensitive Personal Information, we will update this Policy and provide the notices and choices required by law, including the right to limit its use.

3. How We Collect Information

We collect Personal Information when you: create an account or check out as a guest; contact us by phone, email, chat, or social media; subscribe to marketing emails; or simply browse the Services (through cookies and similar technologies, described in Section 5). Information shared in public forums, reviews, or social media comments becomes public, and we have no control over its subsequent use.

4. Notice at Collection

At or before the point we collect Personal Information from you — for example, at account creation, checkout, or newsletter sign-up — we will provide a notice describing the categories of Personal Information collected at that point, the purpose for collection, whether that information is sold or shared, and the applicable retention period, consistent with CPRA's Notice at Collection requirement. This Privacy Policy supplements, and does not replace, those point-of-collection notices.

5. Cookies and Tracking Technologies

5.1 Categories of Cookies

  • Strictly Necessary Cookies: required for the Services to function (e.g., shopping bag security, fraud prevention). These cannot be disabled through our consent tool because the Services will not work without them.
  • Functional/Personalization Cookies: remember your preferences and login status.
  • Analytics Cookies (e.g., Google Analytics — _ga, _gat, _gid): help us understand site usage.
  • Advertising Cookies: used by our advertising partners to deliver relevant ads.

5.2 Consent

Only Strictly Necessary Cookies are placed automatically. Functional, Analytics, and Advertising cookies are not activated until you provide affirmative consent through our cookie banner. Our analytics and advertising tags, including Google Analytics, are configured with consent-mode blocking so that they do not fire prior to your consent. You can change or withdraw your consent at any time through “Cookie Settings” in the site footer.

5.3 Global Privacy Control and Do Not Track

We honor the Global Privacy Control (GPC) signal as a valid opt-out of sale/sharing under CCPA/CPRA for the browser session in which it is sent. We currently treat GPC as the operative browser-based opt-out signal; because there is no single industry standard for Do Not Track (DNT), we do not separately process DNT signals, but doing so via GPC has the same practical opt-out effect for California residents. You can also opt out directly using the methods in Section 8.

5.4 Third-Party and Advertising Cookies

Some advertising partners may place their own cookies through the Services. We do not control these cookies; please consult each partner's privacy policy directly.

6. How We Use Personal Information

  • Processing and fulfilling orders, payments, and returns
  • Creating and maintaining your account
  • Providing customer service and responding to inquiries
  • Sending order, shipping, and account-related communications
  • Sending marketing communications, where you have opted in or as otherwise permitted by law (you may opt out at any time)
  • Improving and securing the Services, including fraud prevention
  • Complying with legal obligations, court orders, and law enforcement requests
  • Analyzing site usage via Google Analytics (only after cookie consent)
  • Email marketing analytics via Klaviyo, based on the consent you provide at sign-up

7. Sale/Sharing and Disclosure of Personal Information

We do not sell your Personal Information for money. Consistent with CCPA/CPRA's broader definition of “sale” and “sharing” (which includes certain cross-context behavioral advertising arrangements), our use of advertising cookies may constitute “sharing” of Identifiers, Commercial Information, and Internet Activity Information with advertising partners. You can opt out of this sharing at any time — see Section 8. We disclose Personal Information to the following categories of recipients:

  • Service Providers: payment processors, shipping carriers, email/SMS platforms (e.g., Klaviyo), IT and hosting providers, and customer service tools, bound by contract to use the information only to perform services for us
  • Affiliates: our corporate affiliates, for the purposes described in this Policy
  • Business Transfers: in connection with a merger, acquisition, financing, or sale of assets, subject to standard confidentiality protections
  • Legal and Safety: to comply with law, respond to legal process, or protect the rights, property, or safety of America & Beyond, our users, or the public

8. Your Privacy Rights and Choices

8.1 Rights for California Residents (CCPA/CPRA)

If you are a California resident, you have the right to:

  • Know/access the categories and specific pieces of Personal Information we collect, use, disclose, and sell or share
  • Delete Personal Information we have collected from you, subject to certain exceptions
  • Correct inaccurate Personal Information
  •  Opt out of the sale or sharing of your Personal Information
  • Limit the use of Sensitive Personal Information (see Section 2 — we do not currently collect Sensitive Personal Information other than as noted)
  • Not be discriminated against for exercising these rights
  • Appeal a denial of a rights request

To opt out of sale/sharing, click “Your Privacy Choices” in our website footer, email
support@americaandbeyond.com with the subject line “CCPA Opt-Out,” or set the Global Privacy Control signal in your browser. We do not require you to create an account to submit a request.

8.2 Rights for EU/EEA and UK Residents (GDPR)

If you are located in the EU/EEA or UK, you have the right to access, rectify, erase, and restrict processing of your Personal Information, object to certain processing, and receive your data in a portable format.
Legal basis for processing: we process Personal Information based on (a) your consent, where required; (b) performance of a contract with you; (c) our legitimate interests, such as fraud prevention and service improvement, balanced against your rights; and (d) compliance with legal obligations.
International transfers: where we transfer Personal Information outside the EEA/UK, we rely on an adequacy decision, Standard Contractual Clauses, or other legally recognized safeguards. Contact support@americaandbeyond.com for a copy.

8.3 Submitting a Request (All Residents)

Email support@americaandbeyond.com with the subject line “Privacy Request” and describe the right you wish to exercise. We will ask for information reasonably necessary to verify your identity before acting on the request. You may also designate an authorized agent to submit a request on your behalf, provided the agent can demonstrate written authorization.

Response timelines:

  • California residents: within 45 days of a verifiable request, extendable once by an additional 45 days with notice to you
  • EU/EEA/UK residents: within one month of receipt, extendable by up to two additional months for complex requests, with notice to you

We do not charge a fee to respond to a verifiable request, except where permitted by law for requests that are manifestly unfounded, excessive, or repetitive.

8.4 Other Choices

  • Marketing emails: unsubscribe using the link at the bottom of any promotional email
  • Text messages: reply “STOP” to any text message from us
  • Push notifications: disable through your mobile device settings
  • Cookies: manage preferences through “Cookie Settings” in the site footer, or through your browser settings

9. Data Retention

We retain Personal Information only as long as necessary for the purposes described in this Policy, or as required by law. Approximate retention periods are:

  • Order and transaction data: retained for 7 years to satisfy tax, accounting, and warranty-related recordkeeping obligations
  • Account data: retained for as long as your account remains active, plus 24 months after closure
  • Customer service records (including call recordings): retained for 24 months
  • Marketing/email subscriber data: retained until you unsubscribe, plus 12 months
  • Website analytics data: retained per our Google Analytics data retention setting, currently 14 months

Where we can no longer identify you, retained data may be kept in de-identified or aggregated form without further restriction.

10. Data Security

We maintain administrative, technical, and physical safeguards designed to protect Personal Information, including SSL/TLS encryption in transit, restricted employee access, and PCI-DSS-compliant handling of payment card data. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security. In the event of a
breach affecting your Personal Information, we will notify affected individuals and applicable regulators as required by applicable state and federal breach notification laws, without unreasonable delay.

11. International Visitors

The Services are hosted in the United States. If you access the Services from outside the United States, your information will be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your jurisdiction. Where required (e.g., for EU/EEA/UK residents), we rely on the safeguards described in Section 8.2 for such transfers.

12. Children's Privacy

The Services are intended for a general audience and are not directed at children under 13 (or under 16 where applicable state law requires parental consent for the sale/sharing of a minor's personal information, e.g., California). We do not knowingly collect Personal Information from children under 13. If you believe a child has provided us with Personal Information, contact us at support@americaandbeyond.com and we will delete it.

13. Digital Accessibility

We are committed to digital accessibility and aim to conform to WCAG 2.1 Level AA. If you experience difficulty accessing content on our site, email support@americaandbeyond.com or call 1-855-ANB-LIVE. We aim to respond within two business days.

14. Changes to This Policy

We may update this Privacy Policy from time to time. If we make material changes, we will post the updated Policy with a new “Last Updated” date and, where required by law, provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the updated Policy.
